Terms and Conditions

These Terms and Conditions constitute a binding agreement between you and individual entrepreneur “Ketevan Kursua" (hereinafter referred to as "the Company" or "Kirke") and govern your use of the purchase and delivery services provided through the website kirke.com.ge.

Personal information obtained by the Company from you or third parties is processed in accordance with the Privacy Policy available on the kirke.com.ge website.

By agreeing to the Terms and Conditions of kirke.com.ge, you also consent to the site's Privacy Policy and Return/Exchange Policy.

All clients wishing to select items and use the delivery service on kirke.com.ge are required to agree to and comply with the following Terms and Conditions. The administration of kirke.com.ge reserves the right to unilaterally amend these Terms at any time by publishing changes on the website without additional consent from the client.

1. Definitions

1.1. The terms used in these Terms and Conditions have the meanings defined below, unless the context clearly indicates otherwise:

  • Terms of Use: Refers to these Terms, along with any other rules and conditions that are considered part of these Terms and govern the relationship between the client and the seller, including any content, functions, and services offered on the website.
  • Website: Refers to kirke.com.ge or the Facebook/Instagram pages through which services are offered.
  • Client: A legal or natural person who meets the requirements set forth in these Terms and wishes to purchase products through the kirke.com.ge platform.
  • Company: Refers to kirke.com.ge and individual entrepreneur “Ketevan Kursua”, registered under Georgian law with identification code 62007010647, registered address: Tbilisi, Tamaz Nadareishvili St. #8a, Apt. 19.
  • User/Users: Clients who agree to these Terms through registration on kirke.com.ge or its Facebook/Instagram pages or who communicate with the Company.
  • Parties: Collectively refers to the Company and its users.
  • Kirke.com.ge Platform: The platform operated by individual entrepreneur ‘Ketevan Kursua’, including communication channels such as Facebook and Instagram pages.
  • Operation: Any action taken by the user related to their personal account or services.
  • Agreement: The contract between users and kirke.com.ge, which includes these Terms and Conditions and any annexes, if applicable.

2. Declarations and Warranties

2.1. By agreeing to these Terms and Conditions, the user confirms that:

  • They are a legal entity established under Georgian law or a legal adult individual.
  • They possess full legal capacity and are not under the influence of narcotics, alcohol, psychotropic, or toxic substances, nor are they under duress, fraud, coercion, or any unlawful influence, and fully understand the implications of these Terms.
  • They have full authority to enter into and fulfill obligations under these Terms or any other agreements and applications.
  • They have reviewed and accept these Terms.
  • All information provided by them is accurate.
  • They are not engaged in any illegal activities as defined by the laws of any jurisdiction, including Georgia.
  • Their actions will comply with local and international laws throughout the duration of the Agreement.
  • Their actions are not intended to deceive kirke.com.ge or any third party.
  • They will perform their obligations under these Terms in good faith and in a timely manner.
  • They consent to kirke.com.ge collecting, verifying, and processing any necessary personal information or universal identifiers for legitimate purposes during the term of the Agreement.
  • They will promptly inform kirke.com.ge at kirkeaccessories@gmail.com of any circumstances that may conflict with these declarations or result in a breach of these warranties.
  • Kirke.com.ge enters into the Agreement based on these declarations, warranties, and obligations, and any breach thereof is sufficient grounds for kirke.com.ge to unilaterally refuse to provide any or all services under the Agreement.

3. Payment Terms

3.1. Clients may make payments via non-cash methods, which implies agreement to these Terms and Conditions.

3.2. For non-cash payments, the recipient is individual entrepreneur “Ketevan Kursua”.

3.3. The Company will assist clients in resolving any issues arising from non-cash payments through its customer service center.

3.4. Clients can make payments to kirke.com.ge using VISA International, MASTERCARD International, or American Express (AMEX) cards, or by transferring funds to the Company's bank account.

Delivery Terms

Kirke.com.ge delivers products through "Unibox" and "Onway" services.

The Company is obligated to deliver the product to the address specified at the time of order. Only the buyer can receive the product. To receive the product, the recipient must present an identity document to the authorized courier from "Unibox" or "Onway."

Product delivery is based on a unique order code. The user is responsible for maintaining the security of this code. Individual entrepreneur “Ketevan Kursua” is not liable for any consequences resulting from unauthorized use of the unique order code.

Upon delivery, the authorized courier will present the package along with accompanying documents and a delivery acceptance form, which must be signed by the recipient. Before signing, the recipient must visually inspect the product. Once the delivery acceptance form is signed, the product is considered delivered, and no further claims from the user will be accepted.

Individual entrepreneur” Ketevan Kursua” will deliver products within Tbilisi through "Unibox" and "Onway" services within 1-3 business days from order confirmation (delivery times depend on the ordered item). If the supplier's warehouse hours end earlier than the specified time and the supplier cannot prepare the product for transport, delivery will occur on the next business day. For addresses outside Tbilisi, delivery will be made within 2-4 business days (delivery times depend on the ordered item).

If the address provided by the user is incorrect or if the user cannot be contacted, the purchased item will be returned to the supplier, and individual entrepreneur ” Ketevan Kursua” will not reattempt delivery.

Delivery service is subject to a fee throughout Georgia.

Product Exchange / Return Policy

  • Sold products can be returned or exchanged only in case of defects, within 3 calendar days of purchase, upon presentation of proof of payment (receipt or bank statement).
  • In all other cases, product exchange is possible within 7 calendar days of purchase; in such cases, the user bears the transportation costs for returning the product and sending the new one. Product exchange is possible upon presentation of proof of payment (receipt or bank statement).
  • Product exchange is allowed only if the product retains its commercial appearance, is undamaged, unused, and presented in its original packaging.
